D. Part III of the Convention – Sale of Goods

The third part of the Convention contains the CISG's core provisions regarding the sale of goods and forms the major part of the Convention. This part follows a very logical structure: After some general provisions the duties of the seller are dealt with, followed by the respective remedies available to the buyer in case of a breach of contract by the seller. This section is then mirrored by the duties of the buyer and the respective remedies of the seller. The following provisions address the passing of risk. The third part is finalized by a number of provisions applying to the remedies of the buyer as well as to those of the seller. Here, you can find i.a. the provisions on the calculation of damages and on exemption as well as on the effects of avoidance, all of which are very important in practice.
